The Johnstone Clan

The Johnstone family name is part of a Scottish clan that goes far back to 1174 when the first known person of this name was John Johnston, who gave his name to the lands of Annandale in Dumfrieshire.

His Great Grandson, named Sir John Johnstone, was a Knight of the county of Dumfries who signed the Ragman Roll of King Edward I of England in 1296.

Over the centuries, the Johnstone clan were involved in many battles against the English for Sottish independence. Since these conflicts, the family grew in more peaceful times, having travelled far and wide.

Today we fight our client battles in the courthouses of Pattaya and Bangkok using the sharpest minds in the legal services industry.

Services

Our Legal Services

We offer a wide range of legal services, as you can see below. If you require legal assistance that is not listed, please feel free to contact us with your issue, and we’ll be happy to arrange a free consultation.

At Johnstone Law Services, we provide our clients with a comprehensive range of litigation services. Litigation services cover many different areas but predominantly focus on criminal law, business disputes, and family law. We have experts in each area who will provide independent and trustworthy advice given by qualified legal experts with several years of experience to ensure that you are in the best possible hands.

Over the years, we have handled criminal actions, commercial and personal disputes, fraud cases and offered reliable business and immigration advice. Johnstone Law Services frequently take on clients that have been rejected by others and successfully won favourable judgements. We believe in giving our clients honest and professional advice, including where we feel, in our professional opinion, a claim or dispute is not worth pursuing.

We will listen to your situation, ask pertinent questions, and formulate a strategy to fight your case. Where necessary, we will offer you coaching as to how to handle a court situation to ensure that you are suitably prepared. Of course, our legal teams will have collated all the documentation or evidence required to fight the case on your behalf, giving you that added peace of mind at a time which will inevitably be stressful.

You will find our legal teams friendly and helpful, and your situation will be dealt with with empathy and, in some cases, compassion. We understand your situation and have helped hundreds of clients in a similar position. Please contact us today for more information about our litigation services.

By its very definition, criminal law relates to where a crime has alleged to have been committed and, in almost all cases, will have police involvement. At Johnstone Law Services, we are frequently asked to represent clients in their defence and, in some instances, to represent the prosecution. We have a team of criminal law experts who can help your defence in court, represent you, and present your case.

Our legal teams are vastly experienced and can help you properly prepare. They will collate evidence, speak to potential witnesses, and ask pertinent questions when cross-examining the prosecution or defence. We will listen to your side, give impartial advice, and construct a plan to address the case. Your lawyer may advise you on how to plead and what remedial action you should take. Our job is to ensure that you receive a fair hearing and that the correct judgement is passed.

Any evidence, information, or thoughts that are shared with our criminal law teams will remain confidential. You should always tell the person or persons representing you the truth so they can prepare for the case effectively. If you form part of the prosecution, you will be asked challenging questions from lawyers, and we will do all we can to prepare you for this. Of course, you must tell the truth in the courtroom, as purgatory is a serious crime.

If you are searching for a criminal lawyer to represent you, please get in touch with us today to find out how we can help you.

People often get confused between criminal law and civil law, and indeed, sometimes, the boundaries can become blurred. The primary purpose of criminal law is to punish a crime, whereas, with civil law, the goal is to find a remedy or solution for the injured party, such as compensation. The objective of civil law is to maintain stability and prevent people from taking matters into their own hands. Civil law cases are brought by private parties such as an individual or company instead of the police or government body. At Johnstone Law Services, we have a dedicated team to handle civil lawsuits. They will represent you in court or during arbitration meetings. Often negotiations are held before that case comes to court to find an amicable solution. However, where this is not possible, we will represent you in court, fighting your case to ascertain liability. We will, of course, advise you when we believe it is not worth pursuing or defending a claim and what settlement you should offer or accept. It is important to remember that our legal teams are acting on your behalf and will fight to achieve the best possible settlement. Any judgement made in a civil court can be appealed by either party, and this is again something that we can assist you with. Should you require more information about civil law and how we can represent you, please contact us.

At Johnstone Law Services, we are experts in assisting our clients in obtaining loans, insurance, or other professional financial advice. You may wish to purchase a property, a vehicle, or consolidate debts; we can advise you if it is possible and the most suitable option. We can help you get a private mortgage, perhaps a mortgage through a bank or car loans from manufacturers or other reliable and trustworthy loan providers. We will assist you in finding the cheapest option and the one that best suits your circumstances.

If you require financial advice regarding pension or investments, we can help along with providing other invaluable financial services such as insurance. We want to help you safeguard your long-term financial future, and our experienced team of advisors can help. We conduct a thorough “Know Your Client” (KYC) analysis to understand your situation, needs, and objectives. You will find our teams incredibly knowledgeable, approachable, and experienced, giving you the peace of mind that you need.

Thanks to our excellent reputation, which we have developed over the years, we have formed excellent relationships with local banks, credit agencies, and private lenders. We also work closely with top local and international insurance companies and the leading overseas investment and pension companies, continually seeking the best deals for our clients.

Please contact us if you want more information about our loan and financial service options.

Family law is a diverse area of legal practice that focuses on family relationships. It can be a pro-active form of law such as pre-nuptial agreements or estate planning; alternatively, it can be reactive, such as divorce or child custody. It is a complex legal area that needs specialist legal knowledge, with cases requiring compassion and understanding due to their sensitive and personal nature.

At Johnstone Law Firm, our expert family lawyers can handle your case. We appreciate that the area is complicated, so we would take the time to listen to your situation before appointing the most appropriate lawyer. Arguably, family law is the most sensitive area of law and is frequently treated as a priority, especially when minors are involved. Of course, we are acting on your behalf, but we will provide impartial advice, advising when we believe it is unwise to pursue a claim.

We have extensive experience in the field, and we fully appreciate that every case is different. Where possible, we will try to use mediation to resolve any issues, attempting to avoid expensive and often emotionally challenging court cases. We are also experts in estate planning and can assist with trusts, a Last Will and Testament, pre-nuptial agreements, or anything else that would fall under the broad umbrella of family law.

It is estimated that approximately 50% of marriages end in divorce. In some cases, the separation can be amicable, and lawyers aren’t required. However, most of the time, the situation can get messy and complex, particularly when children are involved. It is a stressful time for all parties involved, and frequently there is significant resentment and animosity from both sides. We endeavour to bring a level of rationality to the situation, striving to achieve the best outcome for our clients whilst also taking the interest of minors into account.

At Johnstone Law Firm, we represent our clients during divorce proceedings. We offer professional, independent advice to help you receive what you are legally entitled to. Where possible, we will strive to find a resolution outside of the courtroom, reducing the emotional pain and potential costs. We understand the complexity of these types of case and do everything we can to minimise the stress and heartache. We have extensive experience and have encountered almost every problem, so you can be confident that you are in the best possible hands.

When parents separate, deciding the custody rights of a child can be one of the most heart-breaking aspects. Sometimes a parent may want sole custody and be reluctant for the other to have any access to the child. Of course, in this situation, the courts always treat the welfare and best interests of the child as the priority, and we advise our clients accordingly. We will give you an honest assessment of how we expect the case to develop and what parents can realistically expect.

At Johnstone Law Firm, we always strive to get the best results for our clients and help them get what they are legally entitled to and in the child’s best interests. Where applicable, we will collect evidence and statements from relevant parties to present to the court. It can be an emotionally challenging period for all, not least the child, so we will always try to resolve the case as quickly as possible to reduce any undue heartache. However, it should be stressed that any decision can be appealed, which, unfortunately, can lead to extended proceedings.

If you would like advice regarding child custody, please get in touch with us, and we can discuss your situation in confidence.

If you are considering adopting a child in Thailand, it can be an emotionally turbulent experience. Of course, it will be something you have discussed in detail with your partner, but understandably, it is not a straightforward process. Of course, the child’s best interests will be central to the case, but both natural parents must be satisfied for the adoption to happen, whilst detailed checks will also be made on the adult(s) applying for the adoption.

We would strongly recommend using a lawyer, someone with extensive experience with child adoption, to guide you through the process. Thankfully, at Johnstone Law Firm, we have adoption experts who can help ensure that the process is as smooth as possible. Don’t hesitate to contact us if you want more information about our child adoption service.

When it comes to legal documents, you want to ensure they are correct, watertight, and contain no legal flaws or loopholes. At Johnstone Law Firm, our legal experts will check any contracts or legal documents you have prepared, looking for anomalies or errors. Our team will pay incredible attention to detail in all aspects of the wording and guarantee that it is legally binding. Of course, we can prepare documents such as contracts on your behalf, ensuring that they comply with national and, where applicable, international laws.

We also read through any legal documents that others have prepared for you to sign. Once again, we will ensure that they are fair or all parties and establish your rights and obligations. If necessary, we can challenge documents or sections within the papers before signing. Should you have already signed the paperwork, we will establish your position legally, explain that position in laymen’s terms, and represent you in discussions, mediation, or court case. It is our objective to secure your best interests.

Johnstone Law Firm also offer a Notary service should you require any documents notarising. Our service is compliant with local and international standards.

Please contact us if you want more information about our legal documents service.

If you have or are thinking of starting a business in Thailand, you want to be confident that you are doing things correctly and have the proper support. Thailand, like most countries, has strict laws around business operations, especially those owned by foreigners or have a high percentage of foreign employees. At Johnstone Law Firm, we will ensure that your business complies with all Thai law, including registering the business and obtaining any licenses, applying for visas, and work permits.

We will help you set up your business, ensure foreign employees have valid work permits and the correct visa, complete annual accounts, and get them audited and submitted to the relevant authorities. Johnson Law Firm will also ensure that you are correctly set up with the DBD and registered for tax purposes. The labour laws in Thailand can be complex and often have many vagaries that are open to interpretation. At Johnstone Law Firm, we will guide you through this potential minefield, ensuring that you comply with all the laws and that everything is done correctly. We will help you apply for work permits and write legally binding employment contracts, ensuring that you and your employees are covered.

If you are planning to get married, you must make sure that you have everything prepared beforehand. In Thailand, like anywhere else, you and your partner must be legally allowed to get married, meaning that any divorce proceedings have been completed. Of course, this will need to be proven, and for a foreign national, you will need to acquire the correct paperwork from your home country and your embassy. Preparing the paperwork ready for the marriage license can be complex, and this is where Johnstone Law Firm can help. For Thais, this can be obtained from their Amphur in their hometown.

Once you have the documentation, you can be married, with most of the legal formalities either taking place at the end of the ceremony or later at the Amphur. Once you have the Thai documentation and the marriage has been registered, you can then begin getting the marriage recognised in your home country. Again, this is quite complicated and something that we can assist you with.

If you want more information about our marriage services, please contact us.

Unfortunately, with a high percentage of marriages ending in divorce, some couples opt to prepare a prenuptial agreement, often when there is a disparity in the ownership of assets, or a particular asset is an “heirloom”. A prenuptial agreement often referred to as a prenup, is a document that is signed before a couple gets married or enters a civil partnership. The agreement clearly outlines the ownership of the couple’s belongings and how they should be split should they separate.

Although prenuptial agreements are not legally binding in some countries such as the UK, most courts consider them, and they provide significant protection. If you would like more information about prenuptial agreements, please contact us.

Purchasing a property can be one of the most significant investments you make. With potentially substantial sums being spent on a house or condominium, you will want to ensure that everything is correct and legally sound. While real estate agents can find you your ideal home, we strongly advise that you use an independent lawyer to peruse any contracts before they are signed and conduct due diligence.

Regardless of if you are purchasing or selling the property from/to a friend, you should always have a contract that has been professionally prepared. It should clearly state both parties’ rights and obligations, including who should pay any transfer or maintenance fees. A quality lawyer will check that there are no charges on the property and that the documents and ownership are correct and as per the agreement.

We strongly advise that you speak to a lawyer before agreeing to purchase your new investment so they can explain the legalities of buying property. At Johnstone Law Firm, this is a service that we have provided for numerous clients and regard ourselves as experts. If you would like advice or more information about property in Thailand, please get in touch with us.

A bail bond is a form of surety bond and is an agreement established, usually by a court, whereby a sum of money is “put up” to guarantee that a criminal defendant will appear for trial. The sum is only payable if the bail terms are breached. The bail bond will be co-signed by a bondsman, who will charge the defendant a fee for acting as the guarantor that the bond will be paid. Bail figures vary significantly and depend on the severity of the crime and the potential risk of the defendant breaching the terms of their bail.

At Johnstone Law Firm, we can assist you with obtaining a bail bond. If you would like more information about this service, please contact us.
